A Ghanaian lawyer, Richard Sena Hotor, has shared details on the legal process of filing for divorce in Ghana. According to Mr. Hotor, a couple can annul their marriage within one year of the union, but they can only file a divorce petition two years after the marriage.

Speaking to Joy News, he advised that it is advisable for couples seeking divorce to get a lawyer who will listen to their story and situate it within the seven facts proving that the marriage has broken down beyond reconciliation.

The divorce process becomes easier when both parties mutually agree upon the decision. However, in cases where one party disagrees, the other is advised to hire a lawyer to support in filing the petition at any preferred court.

Once the petition is filed, the other spouse is required to file an answer. If a party fails to file, the lawyer moves forward with alternate remedies to the problem. Mr. Hotor emphasized that the court’s completion time for a divorce case is dependent on how complicated the situation is.

He also noted that an individual can appeal to the court if they feel the court has rendered an unfair judgment. It’s important to note that the legal process of divorce in Ghana requires careful consideration and professional guidance to ensure a fair and just outcome for all parties involved.
