Teacher Unions secure court injunction over one teacher one laptop project

Two teacher unions thus: Innovative Teachers (IT) and All Teachers Alliance Ghana (ATAG) have secured court injunction on the distribution of one teacher one laptop project and deduction of teacher’s professional allowance.

The Accra High has placed an interlocutory injunction on the distribution of the 1TMI laptop to teachers following a suit filed by the two teacher unions.

On 12th November, 2021, the National Executives of INNOVATIVE TEACHERS and All Teachers Alliance Ghana (ATAG) issued a statement informing teachers that a suit has been filed at the Accra High Court to restrain distribution of the laptops.

According to the Teacher Unions, the suit is questioning the legal capacity of K.A TECHNOLOGIES GHANA LIMITED and the contract that was given to same by the Defendants herein to manufacture laptops under the one teacher one laptop initiative.

PLAINTIFFS

The Innovative Teachers and All Teachers Alliance Ghana are the first and second plaintiffs respectively.

DEFENDANTS

The Defendants in the suit are as follows:

1. K.A TECHNOLOGIES GHANA LIMITED

2. The Attorney General

3. Ghana Education Service

4. Ministry of Education

It is instructive to note that INNOVATIVE TEACHERS was registered as a TRADE UNION by the Chief Labour Officer in accordance with the Labour Law 2003 (Act 651) on 30th July, 2012.

MOTION ON NOTICE FOR INTERLOCUTORY INJUNCTION PURSUANT TO ORDER 25 RULE 1 (1) OF C1.47.

Motion on Notice by Kwaku O. Anim-Addo, Esq., counsel for the Plaintiffs/Applicants praying the Honourable Court for an order for Interlocutory Injunction restraining the Defendants, their agents, successors, assigns, service men, workmen and all persons claiming through them from awarding or entering into a contract of selling or distributing laptop computers and/or in any way dealing with or interfering with any contract of selling or distributing laptop computers under the one teacher one laptop computer programme pending the final determination of this suit, in terms of the accompanying affidavit.

And any other order(s) that to this Honourable Court may seem fit.

Court to be moved on the 24th day of November, 2021 at 9 O’clock in the forenoon or so soon thereafter as Counsel for the Plaintiff/Applicant may be heard.
