Chieftaincy: Togbe Sogah II and his Stool Father win court case against Dzamesi Gabriel and Co

Togbe Atsuga Sogah ll, the Divisional Chief of Sogakope in the Fievie Traditional Area and Zikpuitor Francis Sogah II, the Sogah Stool Father have won a Court case against one Mr. Gabriel Dzamesi [Sighted in suit as Zikpuitor Gabriel Dzamesi] and Co at the Sogakope District High Court.

The final hearing of the case took place today, Friday, 21st May, 2021 at the Sogakope District High Court presided over by Justice Justin K. Dorgu.

In passing a final judgement on the case brought before the High Court, Mr. Gabriel Dzamesi was asked by the judge to choose from being jailed or fine for his gross misconduct and contempt against the Sogah Stool of Sogakope.

The contemnor Mr. Gabriel Dzamesi was found guilty of contempt of the Judicial Committee of the National House of Chiefs by holding himself as the Zikpuitor of the Sogah Stool when there is an Interlocutory Injunction before the Committee to restrain him from holding himself as such.

The defendant [Gabriel Dzamesi] pleaded guilty and appealed to the High Court through the judge to fine him instead of being jailed for his offense after the lawyer for the Plaintiff [Togbe Atsuga Sogah ll and Zikpuitor Francis Sogah II] Lawyer Zikpuitor Awuku Doe Atakli argued out the case by mounting a strong defence against Lawyer for the defendants [Mr. Gabriel Dzamesi and Co] Lawyer Korbla Hlortsi Akakpo on the case during the final determination in Court.

The panel of the High Court presided over by Justice Justin K. Dorgu unanimously awarded a cost of GH¢2,000 in favour of the Applicant against Mr. Gabriel Dzamesi.  The decision was taken after Lawyer for the Plaintiff Lawyer Zikpuitor Awuku Doe Atakli of Kpatsa and Associates Law Firm in Kanda, Accra proposed an amount of GH¢3,000.00 when the judge sought for his opinion on the decision.

Mr. Gabriel Dzamesi was further cautioned not carry himself as Zikpuitor of Sogah Stool and must not involve himself in any Chieftaincy issues regarding Sogah Stool of Sogakope in the Fievie Traditional Area of the South Tongu District.

Information available to Coverghana.com.gh revealed that, the case started way back in 2010 after the death of the then Stool Father Zikpuitor Papa Sogah where one Mr. Gabriel Dzamesi and others first took the Zikpuitor Francis Sogah II [Current Stool Father] and others to the Dabala Majestrate Court in South Tongu District of the Volta Region challenging the jurisdiction and supremacy of Sogah Stool and Mr. Francis Sogah who was announced the Stool father of Sogah Stool.

Sources disclosed that, the case travel through one Togbe Agbitor of Sokpoe for settlement, the Ho High Court B, back to the Sogakope Circuit Court to the Judicial Council of the National House of Chiefs in Kumasi and finally ended in the Sogakope District High Court on Friday, 21st May, 2021.

Coverghana.com.gh can report that, the case ruled by the Sogakope District High Court was filed by Togbe Atsuga Sogah ll and Zikpuitor Francis Sogah II in 2019 against Mr. Gabriel Dzamesi and Co after failing to honour the summon of the Judicial Council of the National House of Chiefs in Kumasi and went on many radio stations and declared himself as the substantive Stool father of Sogah Stool among others.

The Sogakope High Court has finally ended the case between the parties in favour of the Togbe Atsuga Sogah ll and Zikpuitor Francis Sogah II after a decade now.
