Court orders Ada East District Assembly to pay judgement debt of GH¢386,989.75

An Accra High Court has dismissed a stay of execution application brought before it by the Ada East District Assembly against Mr. Prince Isaac Akplehe a.k.a Nene Teye Adjumani in respect of a judgement debt he won against the assembly.

It would be recalled that Mr. Prince Isaac Akplehe, a contractor has succeeded in getting the commercial division of the Accra High Court to freeze the accounts of the Ada East District Assembly for failing to pay a judgement debt the court awarded in his favor against the assembly.

The Ada East District Assembly in 2016 had contracted Mr. Prince Isaac Akplehe to fix streetlights, bulb igniters as well as rehabilitate some existing streetlights which amounted to GH¢ 89,595.75 but the assembly’s refusal to pay the contractor after work done and his several attempts to get the assembly pay him resulted in him dragging the district assembly to the commercial division of the Accra High Court.

The court, in it’s rulling in March 2022 ruled against the assembly and awarded a cost of GH¢386,989.75 including interest in favor of Mr. Prince Isaac Akplehe.

However, the Assembly’s failure to honor the courts directive to pay it’s debts to the plaintiff led the court to impose further sanctions against the assembly by freezing it’s accounts.

The Ada East District Assembly which was not happy with the judgment applied to the court for a stay of execution.

But the Court presided over by Justice Eric Baah (JA) sitting as an additional judge in it’s rulling on 16th August, 2022 held that the defendant/judgement debtor/applicant was engaging in wasteful litigation at the expense of the time and resources of itself, plaintiff and the court.

Justice Baah again held that the Ada East Assembly’s application lacked merit and therefore dismissed the application brought before it.

The court also ordered that the Ada East District Assembly should go ahead to make payments to Mr. Prince Isaac Akplehe also known as Nene Teye Adjumani.
