Update No. 4: Election Petition Hearing; Parties’ compliance with Supreme Court’s orders

The National Youth Organize of the New Patriotic Party (NPP) Henry Nana Boakye Nana-B has put out an update on the Presidential Election Petition Hearing involving Parties’ compliance with the Court’s orders.

The update released by him reads;

Petitioner’s Compliance


The Petitioner, John Dramani Mahama, in blatant disregard of the Supreme Court’s orders failed to file his witness statements on 21st January, 2021 for same to be served on Respondents. For reasons best known to him however, Petitioner on 21st January, 2021 filed an application for stay of proceedings (to put a temporary hold on the hearing) pending the hearing of his application for a review of the Court’s refusal to grant leave for him to serve interrogatories on 1st Respondent. The Application is to be heard on 26th January, 2021 and the Review Application is also to be heard on 28th January, 2021.

The 1st and 2nd Respondents have both filed an opposition to the application for stay of proceedings.

1st Respondent’s Compliance

The 1st Respondent, Electoral Commission, has filed its written submissions on the preliminary objection raised as ordered and has also filed its witness statements statements as ordered by the Supreme Court.

Update No. 3: Election petition hearing; Supreme Court sets 5 issues for determination of case 

1st Respondent has further applied for an abridgement of time in respect of the review application, thus, for the review application to be heard on the same day the stay is heard which is 26th January, 2021. 2nd Respondent argues that the extended date of 28th January, 2021 was for their benefit since they are to respond to the application for review but they are ready to have it heard earlier in keeping with the expeditious hearing of the petition as intended by C.I.99.

2nd Respondent’s Compliance

The 2nd Respondent, Nana Addo Dankwa Akufo-Addo-Addo, has complied fully with all the orders of the Supreme Court. The 2nd Respondent has filed his written submission in support of the preliminary objection raised against the competency of the petition for same to be dismissed in limine.

Update on Supreme Court’s first Presidential election petition hearing

2nd Respondent has also filed his witness statements even though the Petitioner has failed to serve his witness statement on him as directed by the Court.

Parties shall return to Court on Tuesday, 26th January, 2020.
