Prior to the December 2020 Presidential and Parliamentary elections, the Electoral Commission of Ghana led by Mrs. Jean Mensa has tendered before the Legislative House of Parliament, the Constitutional Instrument (C.I) for conduct of the elections.

In exercise of the power conferred on the Electoral Commission by article 51 of the 1992 Constitution, the Commission has made a number of Public Elections Regulations on 1st day of July, 2020 for the conduct the of December 2020 elections.

These Regulations apply to presidential and parliamentary elections and with the necessary modifications to other public elections that the Electoral Commission may conduct.

According to the C.I 127, the Chairman of the Commission shall be the returning officer for the purpose of the election of the President, except as provided under paragraph (b) of sub-regulation (1) of regulation 3, a person appointed under sub-regulation (3) shall perform the duties assigned by the Chairman of the Commission.

For the purpose of holding Parliamentary elections, the Commission shall appoint a returning officer for each constituency in which the election is to be held; and any other person to assist a returning officer as determined by the Commission.
